These terms are an agreement between you and Summer Cypress Ventures LLC (“we”, “us”) covering your use of the Nimbus Reader app. Please read them before using the app.
By downloading or using Nimbus Reader, you agree to these terms. If you do not agree with them, please do not use the app.
You must be at least 13 years old to use Nimbus Reader. If you are under the age of majority where you live, you need a parent or guardian’s permission, including for any purchase.
Your use of the app is also covered by our Privacy Policy, which explains what information we collect and how we handle it.
Nimbus Reader requires an account. You agree to:
You are responsible for activity that happens under your account. You can delete your account at any time from Settings in the app.
We give you a personal, non-transferable license to use Nimbus Reader on Apple devices you own or control. You agree not to:
The app, its design, and our trademarks belong to Summer Cypress Ventures LLC. These terms do not transfer any of those rights to you.
Books, documents, text, and web pages you import remain yours, or their respective owners’. You are responsible for making sure you have the right to import and read them. We do not review or endorse content you import.
Titles in Discover come from Project Gutenberg through a public catalog. We do not control that catalog and cannot guarantee that any title is available, accurate, or free of copyright restrictions in your country.
Nimbus Reader offers optional auto-renewable subscriptions (“Nimbus Reader Pro”) that unlock additional features. Pro is available as Pro Weekly (1 week), Pro Monthly (1 month), and Pro Annual (1 year). The current price for each plan in your region is shown in the app before you purchase.
Cancelling. If you turn off auto-renew, you keep Pro until the end of the period you have already paid for. Deleting the app or your account does not cancel a subscription; you need to cancel it in your Apple ID settings.
Refunds. Purchases are processed by Apple, and we cannot issue refunds ourselves. Payments are non-refundable except where the law requires otherwise. To ask for a refund, use Apple’s Report a Problem page.
Price changes. We may change subscription prices. A new price applies from your next renewal at the earliest, and you will be told in advance so you can cancel first if you do not want to continue.
Pro Boost. The app may offer Pro Boosts, which are short free trials of Pro reading speed, limited in length and in how many you can use each week. We may change or withdraw them at any time.
Free trials. We may offer, change, or withdraw free trials at any time. If you do not cancel before a trial ends, the subscription you chose begins and you are charged.
Nimbus Reader relies on services from other companies, which have their own terms:
The app may also open or import pages from websites we do not own or control. We are not responsible for their content, policies, or practices.
Some features need an internet connection. Your mobile provider may charge you for data, including roaming, and those charges are yours to cover. You are responsible for keeping your device secure and up to date. Using the app on a jailbroken device may stop it from working properly and is at your own risk.
We may update, change, or remove features, and we may stop offering the app. Updates may be needed to keep using it, and we cannot promise the app will always work with every device or operating system version.
You can stop using Nimbus Reader at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we need to in order to comply with the law or protect the app or its users. If we discontinue the app, your license to use it ends.
Nimbus Reader is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the app will be uninterrupted, error-free, or that it will produce any particular result, such as a specific improvement in your reading speed or comprehension.
To the fullest extent the law allows, Summer Cypress Ventures LLC is not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or business, arising from your use of the app or your inability to use it.
Our total liability for any claim related to the app is limited to the amount you paid for Nimbus Reader Pro in the 12 months before the claim arose.
Some places do not allow certain warranty exclusions or liability limits. Where that is the case, these limits apply only as far as the law permits, and nothing in these terms takes away rights you have as a consumer that cannot be waived.
These terms are governed by the laws of the State of Nevada, United States, without regard to conflict-of-law rules. Mandatory consumer protections in the place where you live still apply.
If you have a concern, please email us first. We will try to resolve it with you informally before either of us takes it further.
If any part of these terms is found to be unenforceable, the rest stays in effect. If we do not enforce a part of these terms on one occasion, that does not mean we give up the right to enforce it later.
Your use of Nimbus Reader, including any subscription purchased through the App Store, is also governed by Apple’s Standard Licensed Application End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
We may update these terms from time to time. We will post the new version on this page and update the effective date. For changes that materially affect your rights, we will make a reasonable effort to give at least 30 days’ notice before they take effect. Continuing to use the app after the changes take effect means you accept them.
